4EVERLAND FOUNDATION LTD. (“4EVERLAND,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy explains how we collect, use, disclose, retain, and protect personal data when you access or use our websites, dashboards, cloud-computing platform, software-as-a-service offerings, application programming interfaces, software, decentralized web hosting and storage, gateways, remote procedure call services, rollup-as-a-service offerings, artificial intelligence services, blockchain-related infrastructure, support channels, and other products and services that link to this Privacy Policy (collectively, the “Services”).

This Privacy Policy also explains choices and rights that may be available to you. It does not apply to third-party products, services, websites, protocols, blockchains, or decentralized networks that we do not control.

For purposes of applicable data-protection law, the controller of personal data described in this Privacy Policy is:

Where we process personal data contained in customer-submitted content solely on behalf of a business customer, that customer is generally the controller and 4EVERLAND acts as its processor or service provider. In that situation, requests concerning that data should generally be directed to the relevant customer.

1. Scope and Key Definitions

“Personal Data” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked to an individual or household, as defined by applicable law.

“Customer Content” means information, files, code, prompts, instructions, images, audio, video, messages, and other material submitted to, stored on, transmitted through, or generated using the Services.

“AI Input” means prompts, instructions, files, or other content submitted to an artificial-intelligence or machine-learning Service.
“AI Output” means content generated and returned by such a Service in response to an AI Input.

2. Personal Data We Collect

The Personal Data we collect depends on how you interact with the Services.

2.1 Information You Provide

We may collect:

  • Account and profile information, such as name, username, email address, organization, country or region, profile image, account preferences, and authentication information;
  • Business and contact information, such as company name, job title, business address, telephone number, and information provided in sales, partnership, or provider applications;
  • Third-party account information, such as identifiers and authorization tokens when you choose to sign in through GitHub or another identity provider. We do not receive your third-party account password unless the provider expressly makes it available;
  • Billing and transaction information, such as billing name, address, tax information, plan, invoices, purchase history, and transaction identifiers. Full payment-card details are generally processed by our payment processor rather than stored by 4EVERLAND;
  • Communications, including support requests, survey responses, feedback, marketing preferences, and correspondence with us;
  • Identity or compliance information, where needed for fraud prevention, sanctions screening, regulatory compliance, enterprise contracting, or account recovery; and
  • Customer Content you submit to or process through the Services.

For our cloud-computing and SaaS Services, Customer Content may include websites, deployment files, source or compiled code, build configurations, objects, databases, logs, domain and DNS configuration, storage content, RPC requests, gateway requests, and other workloads that you choose to process through the Services. Customer Content may contain Personal Data depending on what you or your users submit.

2.2 AI Service Data

When you use our AI Services, we may process:

  • AI Inputs and AI Outputs;
  • selected model, model parameters, endpoint, response status, timestamps, and request identifiers;
  • input and output token counts, compute usage, latency, and other billing or performance metrics;
  • API key or account identifier associated with the request;
  • network and device information described below; and
  • safety, fraud, and abuse signals.

Our handling of AI Inputs and AI Outputs is described in Section 5.

2.3 Information Collected Automatically

When you use the Services, we and our service providers may automatically collect:

  • IP address, approximate location derived from IP address, browser type, device type, operating system, language, and device or advertising identifiers;
  • pages or features viewed, links clicked, referring URL, session duration, timestamps, and interaction data;
  • API requests, endpoint activity, request status, error reports, rate-limit events, and diagnostic logs;
  • cloud and SaaS operational information, such as deployments, build events, storage volume, bandwidth, gateway traffic, RPC usage, selected region, resource utilization, uptime events, and service configuration;
  • account logins, authentication events, security events, and suspected fraud or abuse; and
  • cookie and similar-technology data described in Section 10.

We do not collect precise geolocation unless a feature clearly requests it and you permit collection.

2.4 Information from Other Sources

We may receive Personal Data from:

  • identity, authentication, payment, analytics, security, fraud-prevention, and infrastructure providers;
  • business partners, resellers, referral partners, and event organizers;
  • public sources and professional networks;
  • an organization that provides you access to the Services; and
  • other users who invite you to an account or workspace.

2.5 Blockchain and Decentralized-Network Data

Certain Services may interact with public blockchains or decentralized networks. We may process public wallet addresses, transaction hashes, smart-contract interactions, network identifiers, and other publicly available ledger information. Public ledger data may remain permanently available and is controlled by the relevant network rather than 4EVERLAND.

3. How We Use Personal Data

We use Personal Data to:

  1. provide, operate, maintain, and administer the Services;
  2. create and secure accounts, authenticate users, and manage credentials and permissions;
  3. process transactions, calculate usage, issue invoices, collect payment, and manage credits;
  4. route and complete API and AI inference requests;
  5. monitor availability, debug errors, allocate capacity, and improve reliability and performance;
  6. provide documentation, support, onboarding, and customer success services;
  7. personalize settings and user experience;
  8. communicate about accounts, transactions, security, incidents, policy changes, and Service updates;
  9. send marketing communications where permitted by law and manage communication preferences;
  10. analyze product usage and develop or improve features;
  11. detect, investigate, and prevent fraud, spam, abuse, security threats, prohibited content, and violations of our Terms;
  12. protect the rights, safety, property, and integrity of users, 4EVERLAND, and others;
  13. comply with legal obligations, lawful requests, sanctions, export controls, tax, accounting, and recordkeeping requirements;
  14. establish, exercise, or defend legal claims;
  15. conduct corporate transactions, audits, due diligence, and business planning; and
  16. carry out another purpose disclosed at collection or with your consent.

For cloud-computing, hosting, storage, gateway, RPC, RaaS, and other SaaS Services, we also process data to deploy and deliver workloads, store and retrieve content, resolve network requests, provide dashboards and usage records, maintain infrastructure, balance capacity, apply account limits, and provide the configuration selected by the customer.

We may create aggregated or de-identified information and use it for lawful purposes. We will not attempt to re-identify information that we maintain as de-identified, except to test whether our de-identification processes comply with law.

4. Legal Bases for Processing

If the laws of the European Economic Area (“EEA”), United Kingdom, Switzerland, or another jurisdiction require a legal basis, we rely on:

  • Performance of a contract: to create and manage accounts, provide the Services, process AI requests, provide support, and bill for usage;
  • Legitimate interests: to secure and improve the Services, prevent fraud and abuse, understand usage, communicate with customers, market our Services, and operate our business, where those interests are not overridden by your rights;
  • Consent: for certain cookies, marketing, optional features, and other processing where we ask for consent. You may withdraw consent at any time without affecting prior lawful processing;
  • Legal obligation: to comply with laws, court orders, regulatory requirements, tax and accounting rules, sanctions, and valid legal process; and
  • Vital interests or public interest: where necessary to protect life, safety, or other vital interests, or to perform a task in the public interest as recognized by law.

5. AI Inputs, AI Outputs, Retention, and Model Training

5.1 Processing to Provide AI Services

We process AI Inputs and AI Outputs to authenticate and route requests, provide model inference, return responses, maintain security and reliability, prevent abuse, troubleshoot customer-reported issues, and comply with law.

Depending on the model you select, we may transmit AI Inputs and related request data to an upstream model developer, inference host, or infrastructure provider. We require providers acting on our behalf to process such data under contractual restrictions and appropriate security and confidentiality obligations, subject to model-specific terms disclosed through the Service.

5.2 Default Content Retention

By default, 4EVERLAND does not retain the content of AI Inputs or AI Outputs after the inference response is completed, except:

  1. for transient processing, buffering, caching, and system recovery necessary to deliver the request;
  2. where you intentionally use a feature that stores content or request history;
  3. where limited content is reasonably necessary to investigate a specific security, fraud, abuse, or technical incident;
  4. where you ask us to retain or review content for support;
  5. where an upstream model provider applies a disclosed retention period; or
  6. where retention is required by law.

Transient copies used for request processing, buffering, and service recovery are ordinarily deleted or overwritten within 24 hours unless an exception above applies. If limited AI Input or AI Output content must be preserved to investigate a specific security, fraud, abuse, or technical incident, we retain it only for as long as reasonably necessary for that investigation and ordinarily for no longer than 30 days, unless law requires a longer period.

We retain non-content operational metadata—such as account or API-key identifier, selected model, timestamps, token counts, latency, charge amount, request status, and safety or security signals—for up to 12 months for billing, reliability, capacity planning, security, fraud prevention, dispute resolution, and legal compliance. We may retain billing and transaction records derived from this metadata for the longer period described in Section 9.

5.3 Model Training

4EVERLAND does not use customer AI Inputs or AI Outputs to train or fine-tune generative AI models without the customer’s express authorization.

We do not permit an upstream provider acting solely on our behalf to use AI Inputs or AI Outputs for its own model training unless:

  • you have expressly opted in;
  • the applicable model-specific terms clearly disclose that use before you select the model; or
  • you are using a separately identified public, community, evaluation, or free Service for which such use is an explicit condition.

We may use aggregated or de-identified operational metrics that do not contain AI Input or AI Output content to measure performance, forecast demand, allocate capacity, detect abuse, and improve the Services.

5.4 Sensitive Information

Do not include highly sensitive or regulated Personal Data in AI Inputs unless the specific Service is expressly designed for it and appropriate contractual and technical safeguards are in place. AI Services are not designed to process protected health information, payment-card data, biometric identifiers, government identification numbers, or other specially regulated data by default.

5.5 Customer-Controlled Applications

If you interact with an application built by a 4EVERLAND customer, the customer may independently collect and use your data. The customer’s privacy notice, not this Privacy Policy, governs its independent processing. 4EVERLAND may process that data on the customer’s behalf.

6. How We Disclose Personal Data

We may disclose Personal Data to:

6.1 Service Providers and Subprocessors

Vendors that provide cloud hosting, model inference, content delivery, decentralized infrastructure, payment processing, identity and authentication, analytics, communications, customer support, security, fraud prevention, auditing, and professional services. They may process data only for the services they provide to us and under applicable contractual obligations.

6.2 Model and Infrastructure Providers

When you select or use a model operated by a third party, we may provide that party with AI Inputs, request parameters, and associated technical information necessary to complete inference. The provider and applicable retention or training terms may vary by model. Where reasonably available, model-specific information will be disclosed in our documentation, dashboard, or provider listing.

6.3 Your Organization and Authorized Users

If your account is managed by an organization, its administrators may access and control account information, usage, billing, settings, and Customer Content, subject to the organization’s policies.

6.4 Business Partners

We may disclose information to resellers, integration partners, referral partners, and other parties where you request or authorize an integration or joint offering.

6.5 Legal, Safety, and Rights Protection

We may preserve or disclose information where we reasonably believe it is necessary to:

  • comply with applicable law, regulation, court order, subpoena, or valid legal process;
  • respond to lawful requests from public authorities;
  • enforce our agreements and policies;
  • detect, prevent, or investigate fraud, abuse, security incidents, or unlawful activity;
  • protect the rights, property, safety, or integrity of 4EVERLAND, users, or others; or
  • establish, exercise, or defend legal claims.

Where permitted, we will seek to notify the affected customer before disclosure and will disclose only what is legally required.

6.6 Corporate Transactions

We may disclose Personal Data in connection with a merger, acquisition, financing, reorganization, bankruptcy, sale of assets, or similar transaction. Any recipient will be required to handle Personal Data consistently with this Privacy Policy unless it provides notice of a change as required by law.

6.7 With Your Direction or Consent

We may disclose Personal Data when you direct us to do so, enable an integration, publish information publicly, or otherwise consent.

We do not sell Personal Data for money, and we do not share Personal Data for cross-context behavioral advertising as those terms are defined under applicable U.S. state privacy laws.

7. Public and Decentralized Services

If you choose to publish or transmit information through a public blockchain, decentralized storage network, public gateway, peer-to-peer network, forum, or other public feature, that information may be visible to anyone and may be copied, indexed, or retained by independent third parties.

Because 4EVERLAND does not control independent networks or participants, we may be unable to alter or delete information after publication. Do not publish Personal Data or confidential information unless you understand and accept these characteristics and have a lawful basis to do so.

8. International Data Transfers

4EVERLAND and its service providers may process Personal Data in countries other than the country where you live. Those countries may have different data-protection laws.

When required, we use recognized safeguards for international transfers, such as:

  • adequacy decisions;
  • the European Commission’s Standard Contractual Clauses;
  • the United Kingdom’s International Data Transfer Addendum or Agreement;
  • contractual, technical, and organizational safeguards; or
  • another lawful transfer mechanism.

You may contact us for more information about the safeguards applicable to your Personal Data.

9. Data Retention

We retain Personal Data only as long as reasonably necessary for the purposes described in this Privacy Policy, including providing the Services, maintaining security, resolving disputes, enforcing agreements, and satisfying legal, tax, accounting, and reporting obligations.

Retention depends on the type of data and context:

  • Account and profile data: while the account is active and ordinarily for up to six months after closure, consistent with our existing retention policy, unless a longer period is required for legal, security, fraud-prevention, or dispute-resolution purposes;
  • Billing, tax, and transaction records: for up to seven years after the applicable transaction, or longer if required by tax, accounting, or other applicable law;
  • Support and business communications: for up to two years after the relevant matter is closed, unless a longer period is reasonably necessary to maintain an ongoing customer relationship, resolve a dispute, or comply with law;
  • Security and access logs: ordinarily for up to 12 months, unless a longer period is reasonably necessary to investigate a security incident, fraud, abuse, or violation of our Terms;
  • AI Inputs and AI Outputs: as described in Section 5;
  • Operational AI metadata: for up to 12 months as described in Section 5; and
  • Marketing data: until you opt out or the data is no longer needed, subject to a limited suppression record to honor your preference.

We may retain data longer if needed for a legal hold, investigation, dispute, fraud prevention, safety, or compliance obligation. When retention ends, we delete, anonymize, or securely isolate the data. Residual copies may remain in encrypted or access-restricted backups for up to 90 days before being overwritten under normal backup cycles, unless restoration, security, or legal requirements justify a longer period.

10. Cookies and Similar Technologies

We and our service providers may use cookies, pixels, local storage, software development kits, and similar technologies to:

  • keep you signed in and provide essential functionality;
  • remember preferences;
  • protect accounts and prevent fraud;
  • understand performance and usage;
  • diagnose errors; and
  • measure or personalize marketing where permitted.

Where required, we obtain consent before using non-essential cookies. You can manage choices through our cookie banner or browser settings. Blocking some cookies may affect Service functionality.

We currently may use analytics services, including Google Analytics, subject to our actual configuration. You can learn about Google’s data practices at https://policies.google.com/technologies/partner-sites and may use its opt-out browser add-on at https://tools.google.com/dlpage/gaoptout/.

11. Security

We use administrative, technical, and physical safeguards designed to protect Personal Data, taking into account the nature of the data and processing risks. Measures may include encryption in transit, access controls, authentication, network and system monitoring, logging, vulnerability management, backups, and personnel confidentiality obligations.

No method of transmission or storage is completely secure. We cannot guarantee absolute security. You are responsible for safeguarding credentials, using appropriate access controls, and securing systems and applications that connect to the Services.

12. Your Choices

Depending on the Service, you may:

  • review or update account information through account settings;
  • unsubscribe from marketing emails using the link in the message;
  • manage cookies through our preference tool or your browser;
  • revoke third-party integrations;
  • rotate or delete API keys;
  • export or delete certain Customer Content; and
  • close your account by using account settings or contacting us.

Even after you opt out of marketing, we may send non-promotional communications concerning transactions, security, legal notices, or your account.

13. Privacy Rights

Depending on where you live and subject to legal exceptions, you may have the right to:

  • know whether and how we process your Personal Data;
  • access and obtain a copy of Personal Data;
  • correct inaccurate or incomplete Personal Data;
  • delete Personal Data;
  • restrict or object to processing;
  • receive certain Personal Data in a portable format;
  • withdraw consent;
  • opt out of certain targeted advertising, sale, sharing, or profiling;
  • appeal our decision on a privacy request; and
  • lodge a complaint with a data-protection authority.

We may verify your identity and authority before fulfilling a request. Authorized agents may submit requests where permitted by law, but we may require proof of authorization and identity verification. We will respond within the period required by law. We will not discriminate against you for exercising a privacy right.

If we process Personal Data on behalf of a business customer, we may direct your request to that customer.

13.1 EEA, United Kingdom, and Switzerland

You may complain to your local supervisory authority. EEA authority information is available at https://www.edpb.europa.eu/about-edpb/about-edpb/members_en. United Kingdom residents may contact the Information Commissioner’s Office at https://ico.org.uk/. Swiss residents may contact the Federal Data Protection and Information Commissioner at https://www.edoeb.admin.ch/.

13.2 United States

Residents of certain U.S. states may have rights to know, access, correct, delete, or obtain a portable copy of Personal Data and to opt out of sale, sharing, targeted advertising, or certain profiling.

We may collect the categories described in Section 2; use them for the purposes in Sections 3 and 5; and disclose them to the recipients in Section 6. We do not use or disclose sensitive Personal Data to infer characteristics about individuals except as permitted by law. We retain each category as described in Section 9.

If we deny your request, you may appeal by replying to our decision or emailing contact@4everland.org with the subject “Privacy Appeal.”

14. Children’s Privacy

The Services are not directed to children under 16, and we do not knowingly collect Personal Data from children under 16. If local law sets a higher minimum age for consent to online data processing, that higher age applies.

If you believe a child has provided Personal Data in violation of this section, contact us. We will take appropriate steps to investigate and delete the data where required.

15. Third-Party Services and Integrations

The Services may link to or integrate with third-party websites, wallets, identity providers, applications, blockchains, model providers, and protocols. Their privacy practices are governed by their own notices. We encourage you to review those notices before providing information or enabling an integration.

16. Changes to This Privacy Policy

We may update this Privacy Policy to reflect changes in the Services, law, or our data practices. We will post the revised version and update the “Last Updated” date. If changes materially affect your rights, we will provide additional notice where required, such as through email or an in-product message.

Changes apply prospectively from the effective date unless otherwise stated.
